Fleasy's Terms of Purchase

Introduction

Upper Eight AB (organization number 556982-9699, hereinafter referred to as "Fleasy" or "us"), operates an advertising platform for second-hand goods of all kinds on our website www.fleasy.eu under the brand name "Fleasy." Both private individuals and businesses can act as buyers ("you" or "the customer" hereinafter), while registered and approved businesses can act as sellers.

Fleasy provides advertising space and various tools on the website to enable and facilitate buying and selling but is not a party to the transactions initiated there and bears no responsibility for the goods offered for sale. Purchase agreements are entered into directly between the customer and the seller.

This document, together with the "Privacy Policy," constitutes the terms and conditions for your use of Fleasy's services. By placing an order on our website, you accept these terms.

Fleasy reserves the right to temporarily or permanently suspend customers from our services if we determine that they do not comply with the terms of this agreement.

We at Fleasy also reserve the right to change the terms of this agreement at any time and without notice. However, the terms that applied at the time you placed your order will always apply to that specific order.


Sellers and Listings on the Platform

To be able to list products and receive orders via Fleasy, businesses must go through a registration process and be approved as sellers. As part of this process, they must accept the rules and conditions outlined in the document "Fleasy's Terms of Use for Sellers." For Swedish sellers, information is automatically retrieved from relevant company registers using their organization number. Fleasy must approve the seller before listings and sales can begin.

The seller is fully responsible for the text and image content of their listings.

The seller must own the items being listed and have the right to sell them.

If multiple items are offered in the same listing, the price represents the total cost for all advertised items. It is not possible to purchase the items separately.

All listings and sales conducted through Fleasy must comply with Swedish law. This includes, but is not limited to, the prohibition of listing any material that infringes on others' copyrights or intellectual property rights. Furthermore, no material containing incitement against ethnic groups, child pornography, illegal depictions of violence, or calls to commit crimes may be published.

Listings must not contain material that may be considered offensive or otherwise damage Fleasy's reputation. We have a strict policy against pornography and erotic content; explicit pornographic images and text are prohibited. The same strict policy applies to material that promotes violent or racist ideologies.

The content of the listings must be accurate, relevant, and sufficient for buyers to make well-informed decisions.

It is prohibited to use listings for advertising other businesses or services, and it is also not allowed to include links or references to other websites or email addresses.

Your Order

To purchase listed products, you must use our ordering function, which includes a shopping cart and similar features. If your purchase includes products from multiple different sellers, your order will be divided into separate "orders" for each seller. Once you have completed the ordering process, these orders will become available for management by the respective sellers via their interface on Fleasy.

To place an order, you must have created an account and be logged in. You are responsible for ensuring that the information you provide is accurate. When registering your account, it is your responsibility to protect your login credentials to prevent unauthorized access.

By completing the ordering process, you accept the terms of this agreement and enter into a purchase agreement directly with the seller.

Please note that the ordering process does not include a payment step. Payment is made only after the seller has sent a payment request.

My Account Page

Once you have completed your order, you will continuously have access to information about the order status and subsequent order handling via the "My Account" page. A message with a link to the page will be sent to you via email.

You can also monitor the progress of your order by visiting the specific order page under "My Account" in the user interface while logged in.

Order Management for Sellers

When a customer places an order, it will be displayed in the seller's user interface on Fleasy as an "order" after the seller has logged in. An "order" includes the products that a customer has added to their shopping cart and ordered from a specific seller at a given time.

Once the seller has received your order, the following will occur:

  1. A binding purchase agreement is established between you and the seller.
  2. If the seller offers card payment, you will be redirected to a payment page where you can complete an advance payment for the purchased products. If card payment is not available, a request for advance payment will be sent to you via email.

Payment
You complete the payment to the seller using one of the payment methods specified in the payment request.

If the advance payment is not completed, the seller has the right to cancel the entire order no earlier than five business days after the order confirmation has been sent.


Delivery

If delivery has been selected, the seller is responsible for dispatching the order within five business days after the advance payment has been received. The delivered items must match exactly what was specified in the confirmed order—nothing may be missing, and nothing extra may be included.

Right of Withdrawal and Complaints

All handling of the right of withdrawal and complaints takes place directly between you, as the customer, and the seller, without Fleasy's involvement. This includes, among other things, the right for private customers to cancel their purchase within the framework of the Distance Selling Act and the Act on Agreements Outside Business Premises, as well as the right to file complaints under the Consumer Purchase Act.

The seller has an obligation to proactively cooperate and ensure that your rights as a customer are upheld in cases of withdrawal and complaints. When a returned item is received, the seller must immediately confirm this in their order management system. Any refund to you as a customer must be processed within three business days from the receipt of the returned shipment.

Liability and Limitations

Fleasy cannot guarantee continuous or error-free access to the service.

To the extent permitted by law, we disclaim liability for data loss as well as other damages that may arise in connection with the use of the service. We disclaim all claims and damages that may result from service disruptions, technical issues, or other circumstances related to the service.

Transfer of Ownership

Should Fleasy come under new ownership through acquisition or merger with another company, we reserve the right to transfer our rights and obligations under these terms and conditions to the new owner. In the event of such a transfer, we will inform you about the changes and who now holds the rights and responsibilities on our website. As a user, you do not have the right to transfer your rights or obligations under these terms to another party.
